1. Introduction

Welcome to Mr.Sweep. By accessing or using our Website and services, you agree to comply with and be bound by the following Terms and Conditions. If you do not agree to these terms, you must not use our Website or our services.

These Terms govern the use of our services, as well as your interaction with our Website.

  • Services Offered: We offer a range of chimney services, including chimney sweeping, inspection, maintenance, repair, and safety checks for residential and commercial properties.

2. Services

Our services include the following:

  • Chimney Sweeping: Removing soot, debris, and blockages from chimneys and flues.

  • Chimney Inspections: Inspecting chimneys and fireplaces for safety, structural integrity, and compliance with local fire codes.

  • Chimney Maintenance and Repair: Conducting repairs on damaged chimneys, including relining, brickwork repair, and sealing.

  • Safety Checks: Ensuring that your chimney and fireplace are safe to use.

  • Flue Cleaning and Maintenance: Cleaning and maintaining the flue systems to ensure optimal performance and safety.

We reserve the right to modify, suspend, or discontinue any of our services at any time without prior notice.

3. Booking and Appointment

  • Appointment Scheduling: Appointments can be scheduled via our online booking form, by phone, or email. We will confirm your service request via email or phone. A valid email address and phone number are required to book.

  • Appointment Confirmation: A booking confirmation email or text will be sent once your appointment is successfully scheduled.

  • Service Availability: We offer services based on availability. While we strive to accommodate your preferred dates, we cannot guarantee immediate availability and may suggest alternate times.

  • Late Arrivals: We ask that you be available at the agreed time. If our technician arrives and no one is available to provide access to your property or the work area, we may charge a missed appointment fee of £25.00 and reschedule your appointment.

  • Service Duration: The time required to complete chimney sweeping and related services will depend on the condition of the chimney and other factors. We estimate services will take between [45mins-1hour], but this may vary.

4. Payment

  • Payments are due upon completion of the service, unless otherwise agreed upon.

  • Pricing: All prices are subject to change without notice. Final pricing will be confirmed during the booking process or after an initial on-site inspection. Some services, such as repairs or additional services, may be priced based on the complexity of the work.

  • Estimates: Any quotes or estimates provided before service are non-binding unless specified otherwise. Actual charges may vary depending on the condition of the chimney, any unforeseen repairs, or additional services required.

  • Payment Terms: Full payment is required at the time of service unless prior arrangements have been made. We reserve the right to charge interest on any unpaid amounts after 30 days.

  • Refunds: We will issue a refund if a service is canceled within 48 hours of the scheduled appointment. Refunds are not available for services rendered.

5. Customer Responsibilities

  • Access to Property: You must provide clear access to the chimney, fireplace, or flue area and ensure that there is adequate space for our technicians to perform their work. This includes removing furniture, debris, or personal items from the work area.

  • Pre-Service Requirements: It is your responsibility to ensure that there are no pets, children, or other obstructions in the work area.

  • Safety Precautions: If any hazardous materials or unsafe conditions are discovered during the service (e.g., mold, vermin infestation, carbon monoxide leaks, structural instability), we may suspend the service for safety reasons. You will be notified of the issue, and further action may be recommended.

  • Property Protection: We take reasonable care to protect your property during the service. However, we are not liable for damage resulting from pre-existing conditions, such as unstable surfaces or structural damage that was not previously disclosed.

6. Service Limitations

  • Pre-existing Conditions: We are not responsible for any pre-existing damage or conditions that may affect the performance of our services. For example, if a chimney has a structural issue or blockage that is not visible or detectable without specialized equipment, we are not liable for the discovery or subsequent repairs.

  • Service Results: We do not guarantee the complete elimination of all creosote or soot, especially in cases of heavy build-up or long-term neglect. We will make every effort to clear your chimney to the highest possible standard.

  • Unforeseen Issues: Should we encounter unexpected issues, such as inaccessible chimneys, unsafe conditions, or structural damage, we may need to revise the scope of work and provide a new estimate. You will be informed and must approve any changes before work continues.

7. Warranty and Liability

  • Service Warranty: We offer a limited warranty for the chimney sweeping service. If you are unsatisfied with the quality of the work within [7-14] days, please contact us, and we will re-assess the situation.

  • Liability Limitations: Our liability is limited to the amount paid for the specific service rendered. We are not liable for any indirect, consequential, or incidental damages arising from the performance of the service.

  • Insurance: We carry appropriate insurance coverage, e.g., general liability insurance to protect against any damages that may occur during the performance of our services. We recommend that you also ensure your property is adequately insured for any unforeseen issues.

8. Privacy and Data Protection

We respect your privacy and are committed to safeguarding your personal information. We only collect and use personal information as described in our Privacy Policy, which outlines how we collect, use, and protect your data.

  • Information Collection: When you book a service or contact us, we collect personal information such as your name, contact details, service history, and payment information.

  • Data Retention: We retain your information for as long as necessary to provide our services and for legal or accounting purposes.

12. Governing Law and Dispute Resolution

  • Initial Contact: If you are dissatisfied with any service outside the chimney sweeping scope or believe there has been a mistake, we request that you contact us within 90 days from the date of the service. This will allow us to address the issue promptly and work towards a resolution.

  • Resolution Process: Upon receipt of your complaint or dispute, we will make reasonable efforts to investigate and resolve the issue in a manner that is fair to both parties. We may offer:

  • A reinspection or follow-up service at no additional charge, where applicable.

  • A partial or full refund, depending on the circumstances and at our discretion.

  • An alternative resolution that addresses the concern raised.

  • We aim to provide a resolution within 7 business days of receiving your inquiry.

  • Dispute Beyond 90 Days: Any disputes or complaints that are not raised within 90 days of the service completion will not be eligible for resolution through our dispute process. Mr.Sweep or its employees will NOT be held liable for any issues or complaints raised after this 90-day period. We encourage you to reach out as soon as possible to ensure we can address your concerns.

  • Costs of Dispute Resolution: Any costs or fees associated with mediation or arbitration (including but not limited to the fees of the arbitrator) will be borne by the party that initiates the dispute resolution process unless otherwise ordered by the mediator or arbitrator. However, each party is responsible for its own legal fees and expenses, regardless of the outcome, unless otherwise agreed upon.

  • By accepting these Terms and Conditions, you agree to this dispute resolution process. This helps us resolve issues as efficiently as possible while ensuring that both parties are treated fairly.
